User Provided Information

The Website/services/products obtains the information you provide when you use the Website. When you register with us, you generally provide (a) your name, age, email address, location, phone number, password and your ward’s educational interests; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help. The said information collected from the users could be categorized as “Personal Information”, “Sensitive Personal Information” and “Associated Information”. Personal Information, Sensitive Personal Information and Associated Information (each as individually defined under this Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (the “Data Protection Rules”)) shall collectively be referred to as ‘Information’ in this Policy.   3. We also collect from your mobile device a unique ID (where your device is an iPhone, we also collect the Apple-recommended CFUUID (the Core Foundation Universally Unique Identifier)) and you consent to the same by installation or use of the Website.

  4. You understand and acknowledge that the EdVantage reserves the right to track your location (“Track”) during the provision of the services. Discontinuation of our services, shall not release you from the responsibility, obligation and liability to repay the outstanding amount(s).

You grant, and warrant that you have the right to grant us a non-exclusive, non-revocable, worldwide, transferable, royalty-free, perpetual right to use your user generated content in any manner or media now or later developed, for any purpose, commercial, advertising, or otherwise, including the right to translate, display, reproduce, modify, create derivative works, sublicense, distribute, assign and commercialize without any payment due to you.

Email/SMS/Telephonic Communications

If you opted-in to receive information about our Website, application, service, updates and offers, we will use your name and email address to send the above information to you. If you no longer wish to receive these communications, you can unsubscribe by following the instructions contained in the emails you receive or on our website. Please note that we may send you transactional and relationship messages, even if you have unsubscribed from our marketing communications. For instance, if our service is going to be temporarily suspended for maintenance, we may send you an email to update you of the temporary suspension.

The retention period may extend beyond the end of your relationship with us, but it will be only as long as it is necessary for us to have sufficient information to respond to any issues that may arise later or for our commercial records. We may disclose Information if required to do so by law or in good faith that such disclosure is reasonably necessary to respond to court orders or other legal processes.

  3. We may also retain the user information to provide you paramount services if you reopen your account. Please note, however, that there might be latency in deleting Information from our servers and backed-up versions might exist even after deletion.

Limitation Of Liability

You expressly understand and agree that EdVantage shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, information, details or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) unauthorized access to or alteration of your Personal Information.

  1. We may make changes to this Privacy Policy. In the event that changes are made to this Privacy Policy, we will notify you through communications and will additionally revise the date at the top of the policy. Miscellaneous

  1. This Agreement shall be construed and governed by the laws of New Zealand and courts in Auckland New Zealand shall have exclusive jurisdiction over such disputes without regard to principles of conflict of laws.
